Terms of Use
Important: Please read these Terms of Use carefully before using the codeXX.health app. By downloading, installing, or using the app you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and codeXX.health ("we", "us", "our"), governing your access to and use of the codeXX.health mobile application (the "App") and any related services (together, the "Service").
By downloading, installing, accessing, or using the App you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use the App.
2. Eligibility
You must be at least 16 years of age to use the App. By using the App you represent and warrant that you meet this requirement and that you have the legal capacity to enter into this agreement.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial purposes, as permitted by the Apple App Store Terms of Service.
This license does not include the right to:
- sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App;
- modify, translate, adapt, or create derivative works based on the App;
- reverse-engineer, disassemble, decompile, or otherwise attempt to derive the source code;
- remove or alter any proprietary notices, labels, or marks on the App.
4. Auto-Renewable Subscriptions
codeXX.health offers auto-renewable in-app subscriptions ("Subscription") that unlock access to codeXX Pro features.
4.1 Available Plans
- codeXX Pro — Monthly: USD 5.99 per month. Billed monthly until cancelled.
- codeXX Pro — Yearly: USD 59.99 per year (equivalent to approximately USD 5.00 per month). Billed annually until cancelled.
4.2 Free Trial
Both plans offer a 2-month free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the end of the trial period, the Subscription will automatically renew and you will be billed the applicable Subscription price.
4.3 Billing and Renewal
Payment is charged to your Apple ID / iTunes account at confirmation of purchase. Your Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current Subscription price. You can manage and cancel your Subscription at any time by going to your App Store Account Settings after purchase.
4.4 Price Changes
We reserve the right to change Subscription prices. If a price change affects your Subscription, we will notify you in advance. Continued use of the Service after a price change constitutes your acceptance of the new price.
4.5 Cancellation and Refunds
You may cancel your Subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then. We do not provide refunds except where required by applicable law. Refund requests for purchases made through the App Store must be directed to Apple.
4.6 Apple as Merchant of Record
All Subscription purchases are processed by Apple through the App Store. Apple's standard terms and conditions for in-app purchases apply. codeXX.health is not responsible for App Store billing issues. Contact Apple Support for billing inquiries.
5. Not Medical Advice
The App and all content, recommendations, and outputs it provides are for informational and wellness purposes only. The App is not a medical device and does not provide medical advice, diagnosis, or treatment. Nothing in the App should be construed as a substitute for professional medical advice from a qualified healthcare provider. Always seek the advice of a qualified medical professional for any health concerns.
6. User Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorised use of your account.
7. Privacy
Our collection and use of personal information in connection with the Service is described in our Privacy Policy. The App is designed with a privacy-first approach; AI features run on-device and your health data is not uploaded to our servers without your explicit consent.
8. Intellectual Property
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, and software — are owned by codeXX.health or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Prohibited Conduct
You agree not to:
- use the App for any unlawful purpose or in violation of these Terms;
- interfere with or disrupt the integrity or performance of the App;
- attempt to gain unauthorised access to any systems or networks connected to the Service;
- use the App to collect or harvest any personally identifiable information of other users;
- use automated means (bots, scrapers, etc.) to access the Service.
10. Consent to Use of Data
You agree that we may collect and use technical data and related information — including technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the App. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services to you. Our full data practices are described in our Privacy Policy.
11. External Services
The App may enable access to third-party services and websites ("External Services"). You agree to use External Services at your sole risk. We are not responsible for examining or evaluating the content or accuracy of any third-party External Services and shall not be liable for any such services. Data displayed by any External Service, including medical and health information, is for general informational purposes only and is not guaranteed by us.
You agree not to use External Services in any manner inconsistent with these Terms or that infringes the intellectual property rights of any third party. We reserve the right to change, suspend, or remove access to any External Services at any time without notice or liability.
12. Export Compliance
You may not use or export the App except as authorised by applicable law. In particular, the App may not be exported or re-exported into any country subject to U.S. embargo or to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List. By using the App, you represent and warrant that you are not located in any such country or on any such list, and that you will not use the App for any purpose prohibited by applicable law.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, without notice, if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination shall survive, including Sections 5, 8, 15, and 16.
14. Updates and Changes
We may update the App and these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or on our website with an updated "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
15. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
16. Limitation of Liability
To the fullest extent permitted by applicable law, codeXX.health and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the App, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Austria, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Austria.
18. Apple-Specific Terms (EULA)
These Terms constitute the End User License Agreement ("EULA") for the App as distributed through the Apple App Store. These Terms are between you and codeXX.health only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content, and Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
These Terms serve as a custom EULA that supplements Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. To the extent these Terms are silent on any matter covered by Apple's standard EULA, Apple's standard EULA terms apply.
Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
Maintenance and Support: codeXX.health is solely responsible for providing any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any such services.
Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Product Claims: codeXX.health, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
Intellectual Property: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, codeXX.health, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
Third-Party Beneficiary: Apple is a third-party beneficiary of these Terms and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
In the event of any conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service shall prevail with respect to any rules specifically applicable to App Store usage.
